  1. Introduction
    1. This document constitutes the terms of service ("TOS") for Homework.ai, a mobile application. By using the Homework.ai app, you agree to be bound by the terms and conditions set forth in this TOS.
    1. Homework.ai is a platform designed to assist students with their homework by using language generation technology. Our goal is to provide users with a convenient and reliable tool to help them complete their homework assignments accurately and efficiently.
    1. Please read this TOS carefully before using the Homework.ai app. By using the app, you acknowledge that you have read, understood, and agree to be bound by this TOS. If you do not agree to the terms of this TOS, you may not use the Homework.ai app.
    1. If you obtain homework.ai from either (1) the Apple App Store, you agree to abide by the Usage Rules outlined in the App Store Terms of Service or (2) the Google Play Store, you agree to the Android, Google Inc. Terms and Conditions, which includes the Google Apps Terms of Service.

  1. Use of Homework.ai
    1. You are solely responsible for all content that you generate or transmit through Homework.ai.
    1. You may not use Homework.ai for any illegal or unauthorized purpose, including but not limited to:
      1. violation of any applicable law or regulation
      1. infringement of any intellectual property rights of any third party
      1. transmission of any harmful or malicious code
      1. any other activity that may harm the security or integrity of the Homework.ai platform or any third party.
    1. You acknowledge that Homework.ai has no control over the content generated by its users, and that Homework.ai is not responsible for any such content.
    1. You may not use the Homework.ai app to generate or transmit any content that you do not have the right to transmit or that infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any third party.
    1. You understand that the results generated by Homework.ai are for informational purposes only and are not intended to be relied upon as professional advice. You are solely responsible for verifying the accuracy and appropriateness of the content generated by Homework.ai for your intended use.
    1. Rate limits: To ensure the quality of service for all users, Homework.ai has implemented a rate limit. Exceeding this limit may result in temporary or permanent restrictions on your use of the app. Homework.ai reserves the right to modify the rate limit at any time.
    1. Bot activity: The use of automated systems or bots to access Homework.ai is strictly prohibited. Such activity may result in the temporary or permanent prohibition from using the platform.

  1. Content Restrictions
    1. You may not use Homework.ai to generate or transmit any content that:
      1. is illegal, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;
      1. you do not have the right to transmit under any law or under a contractual relationship;
      1. infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party;
      1. contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
    1. Homework.ai reserves the right to remove any content that it determines, in its sole discretion, to be in violation of these content restrictions or any other provision of this TOS.
    1. You acknowledge that Homework.ai has no obligation to monitor or review any content generated or transmitted through the app, but that Homework.ai has the right to do so for the purpose of operating the app, to ensure compliance with this TOS, or to comply with applicable law or the order or requirement of a court, administrative agency, or other governmental body.
    1. You agree to indemnify, defend, and hold harmless Homework.ai, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of your use of the app, including but not limited to your generation or transmission of content through the app in violation of this TOS.

  1. Intellectual Property
    1. The Homework.ai app and all content, software, text, graphics, logos, trademarks, and other material contained in the app are the property of Homework.ai or its licensors and are protected by intellectual property laws.
    1. You may not copy, modify, distribute, sell, or lease any part of the Homework.ai app or its content, nor may you reverse engineer or attempt to extract the source code of the app, unless laws prohibit these restrictions or you have written permission from Homework.ai.
    1. Homework.ai grants you a limited, non-exclusive, non-transferable, revocable license to use the app for the sole purpose of using the services provided by Homework.ai. This license does not grant you any right to use any trademark, logo, or other proprietary information of Homework.ai without the express written consent of Homework.ai.
    1. You acknowledge that Homework.ai owns all right, title, and interest in the app and its content, and that you will not acquire any right, title, or interest in the app or its content except as expressly set forth in this TOS.
    1. Any feedback, comments, or suggestions you may provide regarding Homework.ai is entirely voluntary, and you agree that Homework.ai may use such feedback, comments, or suggestions without any restriction or obligation to you.

  1. Termination of Service
    1. Homework.ai may, at its sole discretion, at any time terminate or suspend all or a portion of the app, or your use of all or a portion of the app, with or without notice and with or without cause.
    1. Upon termination of this TOS, your right to use the app shall immediately cease, and you shall destroy all copies of any software and all of its component parts in your possession.
    1. The provisions of this TOS regarding intellectual property, content restrictions, representations and warranties, indemnification, and limitations of liability shall survive termination of this TOS.

  1. Subscription and In-App Purchases
    1. Homework.ai may offer various subscription plans and in-app purchases that allow you to access additional features or services within the app.
    1. Subscriptions and in-app purchases may be subject to additional terms and conditions, which will be made available to you prior to your purchase.
    1. You agree to pay all fees and charges incurred in connection with your subscription or in-app purchase, including all applicable taxes.
    1. Subscriptions and in-app purchases are non-refundable, except as provided by law or as otherwise specified in writing by Homework.ai.
    1. Homework.ai reserves the right to change the price or availability of its subscription plans and in-app purchases at any time, and to manage, modify, or discontinue the app or its features and services at any time without notice.
    1. You are responsible for managing your subscription or in-app purchase, including cancelling or changing your subscription plan as desired.
    1. You agree that Homework.ai is not responsible for any unauthorized access to or use of your subscription or in-app purchase, including but not limited to access through unauthorized third-party accounts.
    1. Despite having an active subscription plan, we reserve the right to monitor your usage and apply a fair usage principle to prevent excessive use of our server. If we determine that you are using the server excessively, we may limit or suspend your access to the server, or terminate your account, without refund or compensation, in case you are violating our terms of service. Excessive use of the server may include, but is not limited to, sending an unreasonable number of requests, sending requests at an unreasonably high rate, or otherwise overburdening the server's resources. Since this negatively affects other users, we do not allow it. By using our app and its features, you agree to abide by these fair usage principles.

  1. Disclaimer of Warranties
    1. The app and its content are provided on an "as is" and "as available" basis, without warranty of any kind, either express or implied, including without limitation any warranty for information, services, or products provided through or in connection with the app, including without limitation the security, reliability, timeliness, or availability of the app.
    1. Homework.ai does not warrant that the app will be uninterrupted or error-free, and Homework.ai will not be liable for any interruption or errors.
    1. Homework.ai does not warrant that the app or its content will meet your requirements, or that the app or its content will be accurate, reliable, or free from errors, viruses, or other harmful components.
    1. You acknowledge and agree that you use the app at your own discretion and risk, and that you are solely responsible for any damage to your device or loss of data that may result from the use of the app.
    1. Homework.ai makes no warranty regarding the quality of any products, services, or information purchased or obtained through the app, or the accuracy, timeliness, truthfulness, completeness, or reliability of any information provided through the app.
    1. Homework.ai makes no warranty regarding any goods or services purchased or obtained through the app or any transactions entered into through the app.
    1. The app may contain links to third-party websites or resources, and Homework.ai is not responsible for the availability of such external sites or resources. The inclusion of any link does not imply endorsement by Homework.ai.

  1. Limitation of Liability
    1. You acknowledge and agree that, to the maximum extent permitted by law, Homework.ai will not be liable for any indirect, incidental, special, punitive, or consequential damages of any kind, including but not limited to loss of profits, loss of data, loss of use, business interruption, or damages arising out of or in connection with the app, whether based in contract, tort, strict liability, or otherwise, even if Homework.ai has been advised of the possibility of such damages.
    1. You acknowledge and agree that, to the maximum extent permitted by law, Homework.ai's total liability to you for any claims arising out of or in connection with the app, whether based in contract, tort, strict liability, or otherwise, will not exceed the amount you have paid to Homework.ai in connection with the app in the 12 months preceding the claim.
    1. The limitations of liability set forth in this TOS will apply even if any remedy fails of its essential purpose.
    1. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages, so the above limitations and exclusions may not apply to you. In such jurisdictions, Homework.ai's liability will be limited to the greatest extent permitted by law.

  1. Jurisdiction and Applicable Law for Terms of Service
    1. These Terms of Service will be governed by and construed in accordance with the laws of the jurisdiction in which Homework.ai is headquartered, without giving effect to any principles of conflicts of law.
    1. If you are a resident of the European Union or the United States, the laws of the jurisdiction in which you are located will govern any disputes arising out of or relating to these Terms of Service, the app, or its content.
    1. You agree that any dispute arising out of or relating to these Terms of Service, the app, or its content, will be subject to the exclusive jurisdiction of the courts located within the jurisdiction in which you are located, and you agree to submit to the personal jurisdiction of such courts.
    1. If any provision of these Terms of Service is found to be invalid or unenforceable, such provision will be severed and the remaining provisions will be enforced.
    1. You agree that these Terms of Service and any claims arising out of or in connection with the app, will be governed under the laws of the jurisdiction in which you are located, without regard to its conflict of law provisions.

  1. Changes to TOS
    1. Homework.ai reserves the right, at its sole discretion, to modify or replace these Terms of Service at any time.
    1. If Homework.ai makes material changes to these Terms of Service, Homework.ai will provide you with notice by sending or by displaying a prominent notice within the app.
    1. Your continued use of the app after the effective date of any changes to these Terms of Service constitutes your acceptance of the modified Terms of Service.
    1. If you do not agree to the modified Terms of Service, you must discontinue your use of the app.
    1. Homework.ai may also, in the future, offer new services and/or features through the app (including, the release of new tools and resources). Such new features and/or services shall be subject to the Terms of Service.
  1. Saving Prompts and Results
    1. By using the Homework.ai app, you agree that we may save and store the prompts you submit and the results generated by the app. We may use this data for technical purposes like caching or performance optimizations or for marketing purposes, including but not limited to improving our services, understanding user preferences, and creating promotional materials.
    1. Any personal information collected in connection with the prompts and results will be handled in accordance with our Privacy Policy, which describes how we collect, use, and disclose personal information.
    1. We do not disclose any data that can be traced back to an individual. We understand the importance of safeguarding personal information, and we make every effort to protect the privacy of our users. Despite that we have the right to share your user data with third parties to ensure the functionality of the app.
